When carrying out procurement activities, Joint-Stock Company National Holding QazBioPharm is guided by the Law of the Republic of Kazakhstan “On Procurement of Certain Entities of the Quasi-Public Sector” dated June 8, 2021 No. 47-VII ЗРК and the Rules for the implementation of procurement by certain entities of the quasi-public sector, with the exception of the National Welfare Fund and organizations of the National Welfare Fund, approved by order of the Minister of Finance of the Republic of Kazakhstan dated November 30, 2021 No. 1253 (hereinafter referred to as the Procurement Rules).
In accordance with the requirements of the Procurement Rules, contracts for the purchase of goods, works and services are concluded with a potential supplier through the procurement portal.
The requirements for concluding a contract through a procurement web portal do not apply to the cases provided for in subparagraphs 1), 3), 5), 6), 13), 14), 27) and 33) of paragraph 287 of these Rules, and also do not apply to cases of concluding a contract with a non-resident to whom the draft contract is sent on paper.
Potential suppliers of the Holding and its subsidiaries who have encountered a violation of the procurement rules have the right to appeal the actions or inactions, decisions of the customer to the Centralized Procurement Control Service (CPCS) in the manner and within the timeframes established by Article 16 of the Law “On Procurement of Certain Entities in the Quasi-State Sector”.
It should be noted that if a complaint is filed within the established timeframe, the conclusion of the procurement contract is suspended by the CPSC until the end of the complaint review period. If the facts specified in the complaint are confirmed, the CPSC will take appropriate measures established by the Law, up to and including cancellation of the procurement results.
A complaint about the actions (inactions), decisions of JSC National Holding QazBioPharm or its subsidiaries conducting procurement can be submitted to the Central Health Control Center via the electronic procurement information system.
